GSK under state, federal criminal investigations of Avandia

Avandia drug maker GlaxoSmithKline is under investigation by federal and state law enforcement officials, the company announced in a press release issued on October 21, 2010:

[GSK] is in the process of responding to a US Department of Justice (DOJ) subpoena relating to the development and marketing of Avandia. The Group has received Civil Investigative Demands from a number of States Attorneys General offices relating to the development and marketing of Avandia. These enquiries are at an early-stage, and GSK is cooperating with these offices.

For years, accusations have been made that Glaxo knew of Avandia heart attack risks and tried to conceal the information instead of warning the FDA and public.

On September 23, 2010, ongoing calls for an Avandia recall in the U.S. were answered by the FDA. New Avandia restrictions in the U.S. were announced by the agency. The same day, the European Medicines Agency (EMA) ordered the removal of Avandia and combination diabetes drugs containing rosiglitazone from the market in Europe. While FDA actions fell short of an Avandia recall, new FDA restrictions on Avandia (and its generic rosiglitazone) are expected to reduce its use in the U.S. by 99%.

Avandia lawsuits continue to be filed against GSK to recover financial compensation for personal injury and wrongful death damages on claims that use of diabetes drug Avandia caused heart attack, stroke, congestive heart failure (CHF) and cardiovascular/heart-related death. Avandia settlements in 2010 totaling more than $500 million have been reached. According to GSK’s recent press release, “Litigation regarding Avandia remains pending in US federal and state courts, and new cases continue to be filed.”
